Partec Faces Legal Setback in Patent Dispute with NVIDIA

A Munich patent court has ruled against Partec in its infringement case against technology giant NVIDIA. The decision, delivered on March 11 by the Unified Patent Court (UPC) in its first instance, represents a legal setback for the high-performance computing specialist. However, the company maintains that the ruling contains a strategic silver lining for its core technology.

Court Rejects Infringement Claims

The UPC dismissed the claims brought forward by Partec and its subsidiary, BF exaQC. The litigation centered on European Patent EP 3 743 812 B1, which covers a method for improving the operational efficiency of AI supercomputers. In its reasoning, the court found that NVIDIA’s implemented processes did not meet the specific qualitative requirements outlined in the patent.

A key point of contention was a central feature of the patent concerning the derivation of qualified information from iterative computational behavior for load balancing. The judges determined that this feature could not be substantiated within NVIDIA’s systems as defined by the patent’s claims. Consequently, Partec’s hoped-for legal breakthrough against the US corporation has been delayed.

Validity of Patent Upheld

Despite the unfavorable outcome on the infringement allegation, the court refrained from challenging the validity of the patent itself. Partec’s management has seized upon this aspect, interpreting it as a crucial affirmation of their technology’s relevance in the high-performance computing sector. The protected methodology is considered foundational for modern AI infrastructure.

Partec, a well-established player in its field, contributed to the development of the JUPITER supercomputer, currently ranked as Germany’s fastest. The company now plans to leverage its expertise in Dynamic Modular System Architecture (dMSA) as it prepares its appeal.

Path Forward Involves Lengthy Appeal

The decision to move to the next legal instance ensures the dispute will be protracted. For the licensing entity BF exaQC, significant stakes remain. Enforcing licensing rights against industry leaders is a central pillar of its growth strategy. The forthcoming appeal will ultimately determine whether the dMSA technology possesses the necessary legal scope to compel NVIDIA to pay licensing fees.
